The Courts and Arbitration
One of the three principles of the Arbitration Act, 2013 is that “the Court shall not interfere in the arbitration of a dispute, save as expressly provided in this Act”. Does this mean that the Court is not a competitor but a complement to arbitration? How do courts support arbitration? Panelists will address this question by referring to legislation and case law and the experiences in other jurisdictions.
